For one, not every dispute even goes to trial- the vast majority of them do not, and even when they do, a court-appointed lawyer is commonly significantly less qualified than those found in global, industry-leading firms. This means that even in the countries that do provide a ‘free’ alternative to the individuals that cannot afford to finance their own legal representation, ‘’equal access to justice’’ is rarely acquired, as the relative expertise and knowledge of a person’s lawyer can go a long way in influencing a judge’s final decision. Of course, the aforementioned free alternative is not even guaranteed in the majority of countries, a point that has recently been overturned by the Brazillian National Council of Justice (CNJ) , after a petition from the prominent entrepreneur and current law student. His point was simple; given that Brazillian citizens were required to hire an attorney in order to issue claims in Special Courts, the majority of low-income individuals would seldom seek any sort of ramifications from the legal sector, as they would find it too ‘’uncertain’’ and ‘’costly’’.
